NYS Climate Commitment and Rising Energy Demands in NYS

Signed into law in 2019 by Governor Andrew Cuomo, the Climate Leadership and Community Protection Act (CLCPA) set some of the country’s most aggressive climate mandates intended to transition New York to 100 percent emissions-free electricity by 2040. As of 2023, 28 to 30 percent of electricity generated in New York comes from renewable sources. New York is developing offshore wind, solar, and nuclear energy projects throughout the state in an effort to both reach this goal and to meet rising energy demands. 

Nuclear energy is generally considered clean because it does not emit carbon during the generation process and it is considered reliable because it is not dependent on intermittent sources, such as sun or wind, to operate. Nuclear energy requires finite uranium uranium for the fission process, disqualifying it from classifying as a true renewable source. The demand for electricity is projected to significantly rise across the country and in New York, grid operators anticipate a 50 to 90 percent increase over the next two decades. The electrification of transportation and heating systems in buildings, the development of technologies like heat pumps and electric vehicles, the plans to upgrade aging infrastructure, the construction of data centers and semiconductor manufacturing, and the tightening supply of available generation sources are all contributing factors to the skyrocketing energy demands.  

What is the Nuclear Reliability Backbone Initiative?

New York Governor Kathy Hochul announced “New York’s Nuclear Reliability Backbone Initiative,” in her State of the State speech on January 13, 2026. The Nuclear Reliability Backbone initiative directs state agencies to establish a cost-effective pathway for advanced nuclear generation to support grid reliability. The new Department of Public Service (DPS) agency has been tasked with facilitating the generation of 4 gigawatts of new nuclear energy, in addition to the 1 GW nuclear project announced by New York Power Authority’s (NYPA) in 2025. Currently, 3.4 GW of nuclear energy is generated state-wide and is operated by Constellation Energy. The ultimate goal of the initiative is to generate a total of 8.4 GW of nuclear energy in order to power and support New York’s electric grids. Nuclear energy currently accounts for about 22 percent of New York’s electricity generation. The specific costs for construction and deployment have not yet been defined in New York State’s budget for 2026. NYPA has received bids from over 20 developers to build the new nuclear sites and from at least eight New York counties to host the new nuclear sites

Climate Goals and Reliability

Doreen Harris, the CEO of New York State Energy Research and Development Authority (NYSERDA), expressed support for the nuclear initiative stating, “By creating a stable foundation of always-on energy, the Backbone will allow renewable resources to operate more efficiently and flexibly.” Public Service Commission Chair Rory Christian commented that the nuclear initiative is imperative for continued renewable energy development, “We see nuclear as essential toward meeting the future energy needs in a way that pairs well with our existing renewable energy ambitions.” 

Socioeconomic Benefits

Energy finance expert and executive board member of the nonprofit Nuclear NY Isuru Senevirante describes nuclear as the most scalable of all energy sources and cites the minimal price variation of nuclear power as a key benefit. High fixed capital investments are associated with construction. However, there are no fluctuating fuel prices, unlike with fossil fuels and natural gas use. Senevirante also argues that investing in nuclear energy pays off in the long-run because nuclear energy has a lifetime of about 80 years, while wind and solar power facilities have a lifetime between 25 and 30 years. Paul Wilson, the Chair of University of Wisconsin’s Department of Nuclear Engineering and Engineering Physics also believes nuclear energy is a smart investment and has the potential to make up 40 percent of New York’s energy grid.  

New York state representative Chris Ryan, from Oswego County, is supportive of the nuclear initiative not only for generating reliable clean power, but also for potentially generating more than 1,000 local jobs. Oswego County, along with seven other counties, have declared themselves as candidates to the New York Power Authority (NYPA) for hosting nuclear energy sites.  

Why Do Critics Oppose the Initiative?

Affordability Concerns

Stakeholders against the Nuclear Reliability Backbone Initiative are concerned about the high capital costs of constructing new plants, the lengthy process of construction, and the costs that may be offloaded to ratepayers. Utility rates for consumers are regulated by a bureaucratic process between utility providers, like ConEdison, and state agencies, mainly the Public Service Commission, to negotiate the costs of production and delivery on ratepayers. While the cost of production is increasing due to the factors listed above, the bureaucratic process of regulation has come under political, social, and economic scrutiny

Climate expert Joseph Romm published an executive summary outlining how nuclear projects, such as the recent Vogtle project in Georgia, have had significant cost overruns and delays that resulted in higher rates for consumers. Jessical Azulay, director of the Central New York-based Alliance For A Green Economy, and Joe Heath, legal counsel for the Onondaga Nation, expressed similar affordability concerns for ratepayers. 

Safety Concerns 

Stakeholders have also expressed safety concerns. The Trump Administration issued a series of executive orders in 2025 that removed oversight authority from the U.S. Nuclear Regulatory Commission, including the “As Low As Reasonably Achievable” principle that requires nuclear operators to keep levels of radiation exposure below the legal limit. In his executive summary, Romm explains that these policies increase the risk of unexpected nuclear accidents. A coalition of indigenous leaders, including the Onondaga Nation, the Haudenosaunee Environmental Task Force, and the American Indian Law Alliance, published a paper in 2019 that covers the history of how nuclear energy development has caused suffering on Indigenous communities around the country. Nuclear waste has to be stored safely for hundreds of thousands of years and if not done properly, can contaminate groundwater and the air. The Seneca Nation is still responding to nuclear waste exposure from the 1960s and 1970s, and continues to filter contaminated groundwater at the former West Valley nuclear site. 

Other stakeholders have expressed concerns over the potential security risks of developing modular reactors in terms of weapons proliferation — the uncontrolled and rapid spread of nuclear weapons. Jacobson from Stanford University and Director of its Atmosphere and Energy Program expressed concerns that the development of small modular reactors will encourage nations to develop atomic weapons

Health Risks

Climate scientists and other scientific experts have expressed concerns over the health risks associated with the life cycle of nuclear energy, from mining to waste disposal. While the fission process of uranium does not emit carbon, the mining and enriching processes, and the manufacturing and construction processes, do emit carbon. There is a known link between lung cancer and underground uranium mining. The fission process produces over 100 radioactive chemicals that have the potential to contaminate humans and the environment, posing cancer, birth defects, and other health risks. 

Better Energy Options

Those against the Nuclear Reliability Backbone Initiative believe that the initiative takes vital resources away from further investing in and developing solar, wind, and geothermal energy. Various stakeholders including environmental advocates like Alex Beauchamp, northern region director at Food & Water Watch, state that solar energy equipment, wind equipment, and battery storage technologies continue to advance and become cheaper, while nuclear energy has not. CEO of Nextera Energy John Ketchum explained that wind and solar projects can be completed in under two years, while nuclear projects take upwards of a decade to complete. Environmental advocates are discouraged by New York State’s lag in developing solar, wind, and storage batteries and believe this initiative will detract from these efforts.

Nuclear Energy is receiving bipartisan support across the country, and billions of dollars of investment have poured in from big tech companies, driven by the need to power the growing wave of new data centers. States like New York are taking advantage of this federal and bipartisan support and investment opportunities, while environmental and climate justice advocates continue to oppose and protest the initiative. The nuclear initiative is now at the stage of reviewing solicitations from developers and potential hosting sites, however, further development steps have yet to be publicized.
